By downloading, creating an account in, or using the application ("OpData-Drive" or the "Application"), you accept these Terms of Use. If you do not accept these Terms, please do not use the Application.

1. DESCRIPTION OF THE SERVICE

OpData-Drive is a clinical logbook application that allows physicians and medical teams to record the surgeries and procedures they perform along with case information, to view them statistically, and — if they choose — to back them up through cloud synchronisation.

2. MEDICAL DISCLAIMER (IMPORTANT)

OpData-Drive is NOT a medical device or a clinical decision support system. The Application does not diagnose, does not recommend treatment, and does not replace professional medical judgement. All data held in the Application is record-keeping data entered by the user. Responsibility for clinical decisions rests entirely with the relevant health professional. You are responsible for complying with applicable legislation (Turkish KVKK, relevant health and patient privacy regulations) and with your institution's rules when processing patient data.

3. ELIGIBILITY AND ACCOUNT

To use the Application you are expected to be at least 18 years old and a health professional or otherwise authorised user. When creating an account you agree to provide accurate and current information, to keep your account credentials confidential, and to be responsible for all activity under your account.

4. USER OBLIGATIONS

You agree to use the Application only for lawful purposes; not to infringe the rights of others; not to enter patient or personal data you are not authorised to enter; and not to take any action that would compromise the security or operation of the Application. You are responsible for having the necessary legal basis or consent for the patient data you enter.

5. TEAM SEARCH VISIBILITY

All users who register for OpData-Drive can be found by other OpData-Drive users in team searches by their first and last name, and can be added to a team as a member. This visibility is required for the team features to work, is an inseparable part of creating an account, and cannot be turned off from within the Application. Searches reveal only first name, last name and OpData-Drive ID matches; your patient or case details are not shared in this scope. By registering you accept this visibility.

6. SUBSCRIPTION, FREE TRIAL AND PAYMENTS

The Application may include a free trial period and/or a premium subscription. Purchases are made through the Apple App Store or Google Play using that platform's payment system, and that platform's rules apply. Subscriptions are managed from your store account; refer to your store account settings for cancellation and renewal terms. Except where legally required, refunds are subject to the policies of the relevant store.

7. INTELLECTUAL PROPERTY

The Application and all software, trademarks and design elements within it belong to the Service Provider or its licensors. You are granted a personal, non-transferable, non-exclusive licence to use it within the scope of these Terms. Rights in the data you enter ("User Content") remain with you.

8. PROVISION OF THE SERVICE AND CHANGES

The Service Provider may modify, suspend or discontinue the Application and its features, with prior notice or, where technically necessary, without notice.

9. LIMITATION OF LIABILITY

The Application is provided "as is" and "as available". To the maximum extent permitted by applicable law, the Service Provider shall not be liable for loss of data, loss of profit, or indirect, incidental or special damages. You are responsible for backing up your data and for verifying its accuracy.

10. TERMINATION

Your account may be suspended or terminated if you breach these Terms. You may request closure or deletion of your account at any time (see Privacy Policy — Account and Data Deletion).

11. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the Republic of Türkiye.

12. APPLE APP STORE ADDITIONAL TERMS (LICENSED APPLICATION)

If you obtained the Application through the Apple App Store: these Terms are between you and the Service Provider, not Apple. The Service Provider alone is responsible for maintenance and support of the Application. Apple has no warranty obligation with respect to the Application; if the Application fails to conform to any applicable warranty, the available remedy may be limited to Apple refunding the price you paid. Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you. You use the Application representing that you are not located in a country subject to a U.S. embargo and are not on any U.S. prohibited or terrorist party list.

13. CHANGES

These Terms may be updated from time to time. Material changes will be announced within the Application or by e-mail. Continuing to use the Application after an update means you accept the changes.
